01 The agreement
These Terms of Service ("Terms") are a binding agreement between you and Social Content ("Social Content", "we", "us"), governing your access to and use of the Social Content application, website, and related services (collectively, the "Service").
By creating an account or using the Service you confirm that you are at least 16 years old, have the authority to enter into this agreement, and accept these Terms together with our Privacy Policy.
02 Your account
You are responsible for safeguarding your credentials and for all activity on your account. Notify us promptly at security@socialcontent.app if you suspect unauthorized access.
You must provide accurate information when signing up and keep it current. One person or legal entity may operate one workspace under a free plan unless otherwise agreed in writing.
03 Acceptable use
You agree not to use the Service to:
- infringe anyone's intellectual property, publicity, or privacy rights;
- generate, store, or distribute unlawful, deceptive, harassing, or hateful content;
- circumvent security measures, reverse-engineer the Service, or attempt to access another workspace;
- scrape, resell, or wrap the Service into a competing product;
- upload malware, run unauthorized automation, or attempt to overwhelm the Service.
We may, at our discretion, remove content or suspend accounts that we reasonably believe violate these Terms or threaten the integrity of the Service.
04 Your content
"Your Content" means anything you submit to the Service — brand profiles, prompts, source material, uploaded assets, and posts you create. You retain all ownership rights in Your Content.
You grant Social Content a worldwide, royalty-free, non-exclusive license to host, transmit, process, and display Your Content solely as needed to operate and improve the Service for you. We will not sell Your Content. We will not use Your Content to train foundation models without your explicit opt-in.
You are responsible for the rights to publish anything you submit and for the posts you ultimately share to third-party platforms such as Instagram.
05 AI-generated output
The Service uses machine learning to generate copy, layouts, and imagery ("Output"). To the extent allowed by law, you own the Output you generate from your inputs, subject to the underlying model providers' terms and to these Terms.
Output can be inaccurate, biased, or visually similar to other outputs generated for other users. You are responsible for reviewing Output before publishing it and for ensuring it complies with the rules of the platforms on which you share it.
06 Plans and billing
The Service offers a free tier and paid plans. Paid plans renew automatically at the cadence you select until cancelled. Fees are non-refundable except where required by law or explicitly stated. We may change pricing with at least 30 days' notice; changes apply to the next billing cycle.
07 Our intellectual property
The Service, including its design, codebase, brand, and supplied templates, is owned by Social Content and protected by intellectual property laws. Nothing in these Terms transfers ownership of the Service to you.
08 Termination
You can stop using the Service at any time from your account settings. We can suspend or terminate access if you materially breach these Terms, present a security or legal risk, or fail to pay. Sections that by their nature should survive termination (ownership, disclaimers, liability, dispute resolution) will survive.
09 Disclaimers
The Service is provided "as is" and "as available". To the maximum extent permitted by law, Social Content disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Service will be uninterrupted, error-free, or always available.
10 Limitation of liability
To the maximum extent permitted by law, Social Content will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill arising out of your use of the Service. Our total aggregate liability for any claim under these Terms is limited to the greater of (a) the amount you paid Social Content in the 12 months preceding the claim, or (b) one hundred US dollars.
11 Changes to these Terms
We may update these Terms from time to time. If we make a material change, we will notify you by email or in-app banner at least 14 days before the change takes effect. Continued use after the effective date means you accept the updated Terms.
